Resolution Through Arbitration
Arbitration is a less formal means of resolving a business dispute than litigation in court. A panel of one or more neutrals (who are selected by the parties) hears the evidence and arguments of both sides and then renders a final, binding decision.
Arbitration offers advantages over formal courtroom litigation in that it is typically less costly and time consuming. However, there are disadvantages to arbitration as well. For example, in the arbitration process, rules of evidence are much less strict than in a trial. Hearsay and other evidence that ordinarily would not be allowed in court may be presented to an arbitrator. In addition, arbitration decisions are typically final, with no right to appeal. (An arbitration agreement may, but usually does not, provide for some right to appeal.)
